Welcome to Jevic Transportations ("Company," "we," "us," or "our"). By accessing or using our website at jevictransportations.com and any related pages, features, or services (collectively, the "Platform"), you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and all applicable laws and regulations.

If you access our Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" shall refer to such entity.

You must meet the following requirements to use our Platform and services:

• You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
• You must have the legal capacity and authority to enter into binding contracts under applicable law.
• You must not be located in, under the control of, or a national or resident of any country subject to U.S. government embargoes or designated as a "terrorist supporting" country.
• You must not be listed on any U.S. government list of prohibited or restricted parties.
• You must not have previously been suspended or removed from our Platform for any violation of these Terms.

We reserve the right to verify your eligibility at any time and to suspend or terminate access if eligibility requirements are not met.

Jevic Transportations provides freight, logistics, and transportation services throughout the United States. Following our recent reopening, we offer an expanded and modernized suite of services including, but not limited to:

• Freight Transportation — Full truckload (FTL) and less-than-truckload (LTL) shipping services across domestic corridors.
• Logistics Management — End-to-end supply chain coordination, warehousing, and distribution services.
• Track & Trace — Real-time shipment tracking accessible at jevictransportations.com/track-and-trace.
• Custom Freight Solutions — Tailored shipping plans for businesses with specialized cargo requirements.
• Last-Mile Delivery — Final leg delivery services to end consumers and business recipients.

We reserve the right to modify, suspend, or discontinue any service or feature at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

Certain features of our Platform may require you to create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the confidentiality of your account credentials, including your password.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately at security@jevictransportations.com of any unauthorized use of your account or any other breach of security.
• Not share your login credentials or access your account on behalf of any third party without proper authorization.

Subject to these Terms, Jevic Transportations grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform solely for your personal or internal business purposes related to our transportation and logistics services.

Permitted uses of our Platform include:

• Requesting freight and logistics service quotes and bookings.
• Tracking and monitoring your shipments through our Track & Trace portal.
• Communicating with our customer service team regarding active or prospective shipments.
• Accessing and downloading documents related to your shipments (bills of lading, invoices, receipts).
• Reviewing service descriptions, policies, and informational content for legitimate business evaluation purposes.

You may NOT use our Platform to:

1. Violate any applicable local, state, federal, or international law or regulation.
2. Transmit any material that is fraudulent, harassing, defamatory, obscene, or otherwise objectionable.
3. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
4. Attempt to gain unauthorized access to any portion of the Platform or its related systems or networks.
5. Use any automated means, including bots, scrapers, or spiders, to access or interact with the Platform.
6. Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
7. Attempt to reverse engineer, decompile, disassemble, or derive source code from any portion of our Platform.
8. Circumvent, disable, or interfere with security-related features of the Platform.
9. Collect or harvest any personally identifiable information from the Platform.
10. Transmit any shipment containing illegal, hazardous, or prohibited materials under federal or state law.
11. Use our services to facilitate fraud, money laundering, or any other criminal activity.
12. Infringe upon any intellectual property rights of Jevic Transportations or any third party.

Violations of this section may result in immediate termination of your account and access to our services, and may be reported to appropriate law enforcement authorities.

All content, features, and functionality available through our Platform — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — are the exclusive property of Jevic Transportations or its content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Jevic Transportations name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jevic Transportations. You must not use such marks without the prior written permission of Jevic Transportations.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JEVIC TRANSPORTATIONS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages arising from your inability to access or use the Platform, any unauthorized access to or alteration of your data, or any third-party conduct on the Platform.
• Damages relating to cargo loss or delay beyond the limits established in your applicable shipping contract and governing freight tariffs.
• Damages resulting from force majeure events, including acts of nature, labor disputes, governmental actions, or other events outside our reasonable control.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the amount paid by you to Jevic Transportations in the twelve (12) months preceding the claim, or (b) $500.00.

You agree to defend, indemnify, and hold harmless Jevic Transportations, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of the Platform in a manner not authorized by these Terms.
• Your violation of any third-party rights, including intellectual property rights or privacy rights.
• Any content you submit, post, transmit, or otherwise make available through the Platform.
• Your violation of any applicable law or regulation.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

By using the Platform, you consent to the collection and use of your data as described in our Privacy Policy. We implement industry-standard security measures to protect your personal information; however, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure.

We reserve the right to revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform thereafter.

We will notify you of material changes by:

• Posting an updated "Last Updated" date at the top of this page.
• Sending an email notification to registered account holders where we have your contact information.
• Displaying a prominent notice on the Platform homepage.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page regularly so you are aware of any changes, as they are binding upon you.

We may terminate or suspend your access to all or part of the Platform, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your license and right to access the Platform will immediately cease.
• Any pending service requests may be cancelled at our discretion.
• You remain liable for any outstanding obligations, including payment of fees for services rendered.
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may also terminate your account at any time by contacting us at support@jevictransportations.com. Termination does not relieve you of any obligation to pay amounts owed prior to termination.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the state in which Jevic Transportations maintains its principal place of business, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in our principal jurisdiction, and you hereby consent to personal jurisdiction and venue therein.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
